Disobedience has no place in prison, protect Integral Revolution

SUMMARY
Framed within the integral revolution, this is a collective initiative promoted by the support group for Enric and aimed at funding the
organizational structure for preventing any disobedience activists from ever going to prison.
CONTEXT AND CURRENT SITUATION
At this moment, the trial process of Enric Duran is at a standstill after he did not appear before the judge the last 12th of February. As of today he still doesn't have a lawyer but despite this, since the 13th of March the provincial court passed a resolution decreeing search seizure and detention for Enric Duran. This is what the prosecutor had asked for in court. We will appeal this sentence because we do not consider it legitimate to enact changes in a legal status if there is no-one responsible for the defense.

Whatever happens, Enric has no intention of participating in a trial where the political motives of the action are not taken into account;
particularly the defence argue of necessity that has been totally ignored, rejecting all of the 23 witnesses presented.
In his latest communications (reading recommended: http://www.enricduran.cat ), our colleague has expressed that he does
not believe the current judicial system is legitimised to judge him.

He maintains that he can be more reciprocal to society if he is free rather than in prison. He has also written an open letter addressed to the
judge and the prosecution where he states that he will not accept any decision made without him participating, because he believes in a method
of conflict resolution where all the concerned parties are part of the decision. For this reason, he has announced in this letter that he will
work to present a proposal that would benefit the whole of society.
WHAT ARE OUR GOALS?
  • To support the creation of an organizational structure to protect the bodily integrity of Enric Duran and other activists who are committed to the transformation of society, the Integral Revolution and freedom of speech, or that at some time are persecuted by the State’s judicial, repressive and economic powers, and of those who wish to disobey. · To support the research and development of integral strategies to guarantee that disobedient activists are not persecuted or threatened with prison. In this sense, to further the search for alternatives to the judicial system and a failing criminal justice system based on imprisonment, which may also benefit many social groups that could be affected by penitentiary measures at any given time.
  • To promote freedom of speech by sharing information and censored content that has not been made public due to the pressure of the established powers. This structure will also allow the consolidation of ways of study and research that nowadays cannot be developed and which are sources of spreading knowledge related to health, technology, energy…

Many of us know cases of persecuted researchers and murdered journalists. In Mexico alone, 71 journalists have been murdered in the past 12 years. The case against Julian Assange, responsible for Wikileaks, is quite visible.

It has been more than a century since the Tesla case, a genius of energetic inventions. The state of poverty in which he lived his last days is still food for thought.

Apart from these well known cases there are hundreds of situations where there is censorship and pressure from the de facto powers, against whom more could be done with a collective structure such as this one.

Given that it is getting riskier to defend freedom of speech and the common good, it is necessary to create new self-managed protection structures that are capable of making us invisible in front of the systems of control in their different aspects.

At the same time, we are working towards greater international reach.

We belong to the group supporting Enric Duran. We are disobedient  activists working towards the integral revolution.

GEOGRAPHICAL SCOPE
This experience will take place in Catalunya, where projects and initiatives and the human interactions arising from these will be
promoted. At the same time, we are working towards greater international reach.
WHAT IS THE MONEY FOR?
To cover logistics needs specific to this initiative during its initial phase. This is key because the foundations to allow its progressive
expansion will be established at this stage. Further to this campaign and in accordance with the dimension of the goals of this project, the
funding ways will be diversified.

La desobediència no hi cap a la presó, protegim la Revolució Integral

RESUM DEL PROJECTE

Aquesta és una iniciativa col·lectiva impulsada pel grup de suport a Enric Duran, en el marc de la Revolució Integral, per finançar una estructura organitzativa de protecció perquè cap persona desobedient no hagi d’anar mai a la presó.

CONTEXTUALITZACIÓ I SITUACIÓ ACTUAL

La situació actual del procés judicial de l’Enric Duran està en un atzucac després que no es presentés al judici del 12 de febrer. Ara per ara encara no té advocat, però tot i així s’ha sabut aquest 13 de març la resolució de l’Audiència Provincial que decreta recerca, captura i presó per Enric Duran, tal i com havia demanat el fiscal el dia del judici. Aquesta sentència es recorrerà per nulitat donat que no considerem legítim que es puguin decretar canvis en una situació legal sense que existeixi una persona responsable de la defensa.

Passi el que passi, l’Enric no té cap intenció de col·laborar en un judici en contra seva en què no és considera la motivació política de l’acció; en concret, l’argument legal de l’estat de necessitat ha estat totalment ignorat i s’ha desestimant un a un els 23 testimonis que havia presentat. El nostre company, a través dels seus darrers comunicats (que recomanem llegir: enricduran.cat) ja ha manifestat, a més, que no creu que el sistema judicial actual estigui legitimat per jutjar-lo.

Sosté que pot ser molt més recíproc amb la societat si està lliure que si el posen a la presó i ha escrit una carta oberta adreçada al tribunal i a l’acusació, en què manifesta que no acceptarà cap decisió en que no pugui participar, perquè creu en un métode de gestió dels conflictes en què totes les persones afectades puguin ser part de la decisió. Per aquest motiu ha anunciat, a través de la mateixa carta, que treballarà per presentar una proposta que beneficiï a tota la societat.

QUÈ VOLEM FER? OBJECTIUS

  • Donar suport a la creació d’una estructura organitzativa per protegir la integritat física de l’Enric Duran i d’altres activistes compromesos amb la transformació de la societat, la Revolució Integral i la llibertat d’expressió, que en un moment donat siguin perseguits per les estructures judicials i repressives de l’Estat i dels poders econòmics, i vulguin escollir l’opció de la desobediència.
  • Donar suport a la investigació i al desenvolupament d’estratègies integrals per garantir que cap més activista desobedient sigui perseguit i amenaçat d’anar a la presó. Una d’aquestes línies de treball és la d’aprofundir en alternatives al sistema judicial i al també fracassat model penal basat en l’empresonament, amb què es vol beneficiar, també, a diversos col·lectius socials que en un moment donat puguin veure’s afectats per mesures penitenciàries.
  • Fomentar la llibertat d’expressió a través de la difusió d’informació i contingut silenciat, que no s’estiguin fent públics per la pressió dels poders establerts. Aquesta estructura permetrà, també, la consolidació de vies d’estudi i d’investigació que actualment no poden desenvolupar-se i que són fonts d’alliberament de coneixements relacionats amb la salut, la tecnologia, l’energia…

Molts i moltes coneixem exemples de casos d’investigadors perseguits, informadors i periodistes assassinats. Només a Mèxic han silenciat amb la mort a 71 periodistes en 12 anys.

Es prou visible el cas de la persecució contra Julian Assange com a responsable de Wikileaks.

Fa un segle ja del cas de Tesla, el geni dels invents energètics; i la misèria económica que va acompanyar els seus darrers dies, encara dona que pensar.

Més enllà de casos tant coneguts, hi ha centenars de situacions de censura i pressió dels poders fàctics, davant dels que es podrà fer més coses amb una estructura col·lectiva com aquesta.

Com que cada vegada s’està fent més arriscat defensar la llibertat d’expressió i el bé comú, es fan necessàries noves estructures autogestionades de protecció que siguin capaces de fer-nos invisibles davant dels sistemes de control del poder en les seves diverses cares.

Aquesta experiència i vivència es produeix al territori de Catalunya, a través dels projectes i iniciatives impulsades i les interaccions humanes que s’han generat al voltant d’aquestes.

A QUÈ DESTINAREM ELS DINERS?
A cobrir les necessitats logístiques específiques d’aquesta iniciativa durant la fase inicial del projecte, etapa clau per al procés, ja que s’establiran els fonaments que permetran que la seva estructura organitzativa s’estengui progressivament. Més enllà d’aquesta campanya, i d’acord amb la dimensió dels objectius d’aquest projecte, les vies de finançament es diversificaran.
